FULL STACK DIGITAL MARKETING PROGRAM

DEFINITIONS

The followingwords and expressions shall, unless the context requires otherwise, have thefollowing meanings as set out below:

Assessment - means various forms of tests thatare conducted to evaluate the learning outcomes for each Learner in theProgram.

Attendance -means attending the Live Virtualconnect sessions by a learner for a significant part of the planned duration -.

Award/Title - is the certificate conferredto a Learner in the form of a digitally verifiable document,upon successful completion of the Program and meeting all the requiredprerequisites for conferring the same.

Batch - is launched to facilitate the executionof a Program. A Batch is identified with its uniqueBatch Code, and its other attributes such as days andtime of execution, start and projected end date. Candidates are allocated a batch, to learn and complete therespective program.

Candidate - shall mean an individual meeting theEligibility Criteria of the program.

Career Guidance – shall mean the Candidates areprovided support in creating their online portfolio, LinkedIn profiling andsoft skill workshop.

Certificate is the digitally verifiable documentissued to the Learner upon completing the Program and meeting the requiredprerequisites as applicable for completion of the said Program.

Credential - shall include all the documentscertifying the age, address, degree certificate etc. obtained by the Candidate.The Candidate shall be required to produce the original of the Credentials ifrequired by NIIT or the Prospective Employer.

Eligibility Criteria - shall mean the eligibilitycriteria that the Candidate must meet before he/she applies for the program

Learner - shall mean the Candidate who has takenadmission in the said program at NIIT as per the admission criteria andevaluation process.

Learning Portal - Learners will be able to accessthe needful resources at the Learning Portal or Learning Management System(LMS) after enrollment. Learner s access to the Learning Portal will begoverned by the terms and conditions, which are available on the Portal.

NIIT – shall mean NIIT Ltd, having its registeredoffice at 8, Balaji Estate, Sudarshan Munjal Marg, Kalkaji, New Delhi 110020.

Offer Letter - shall mean a letter issued by aProspective Employer offering gainful engagement / employment to the Learner tojoin their organization from a particular date and for a particular position.

Payment Option – shall mean any of the optedPayment plan as mentioned in the program page of the NIIT website.

Placement - shall mean the offer of engagement /employment from a Prospective Employer by issuing an Offer Letter.

Placement Assurance - shall mean the assurance ofPlacement to the Candidate who has duly complied with the mentioned Terms Conditions.

Placement Assistance – shall mean providing uptomaximum 3 selection opportunities to the Candidates who has duly complied withthe mentioned Terms Conditions.

Procedure - shall mean the procedure to befollowed by the Candidate for his/her Placement.

Program - shall mean the program mentioned in theapplicability section for which the Learner has taken admission at NIIT.

Program Fee - shall mean the total fee for theprogram payable by the Learner for the services opted with the program,including Admission, Tuition Fee, Placement Fee, and Funding Charges (ifapplicable). Applicable taxes to be paid on and above the Program Fee.

Prospective Employer - shall mean the third partyorganization who may issue the Offer Letter to the Candidate for his/herPlacement.

StackRoute – shall mean StackRoute (An NIITinitiative). StackRoute is a division of NIIT that runs programs to produce topclass full stack engineers and tech professionals with deep skills.

APPLICABILITY

These Terms andConditions (T C) shall apply to the Learner of the Full StackDigital Marketing Program (FSDMP). The enrolled Learner is bound by therules, regulations, timings, administrative procedures and disciplinerequirements as applicable and must necessarily comply with the programguidelines.

PROGRAM ADMISSION

The Candidateneeds to apply for the program by filling the online application form on www.niit.com/India . It is implied that theCandidate is fully aware of the eligibility requirements and program detailsmentioned on the website and then applying.

The Candidate needs to submit/upload the scannedcopies of the following documents and produce the originals for verificationwhen required.

 i.         Date of Birth:10^th certificate / Passport

ii.         AcademicPerformance: Mark Sheet and/or Certificates of Class 10^th, 12^th, Graduation, Post-Graduation(If applicable)

iii.         Work experience(If applicable): Last salary slips, appointment letter relieving letter

iv.         Identity: PANCard

In the event ofnon-submission and/or being unable to produce the originals and/or discrepancyin the documents/information furnished by the Candidate, the admission will bewithheld / cancelled anytime at the sole discretion of NIIT with no refund ofthe fee paid.

Selection to the program is based on theperformance in the Admission Test (which may include Aptitude Test, LanguageTest, Programing Test and Personal Interview etc.,).

Selected Candidates will receive the AdmissionSelection Letter by email, post which they would need to pay the applicableprogram fee on/or before the last date mentioned in the letter.

The Admission selection letter is not transferableand does not guarantee the seat unless the registration formalities arecompleted within the last date mentioned in the letter or before the admissionsare closed for the batch whichever is earlier.

The registration is for a specific Program and fora specific batch with defined delivery schedule only. Therefore, the admissionis valid for the specific program and batch and period. Candidate is expectedto complete the program as per the batch schedule within this period.

Due tounavoidable reasons if the batch start date is revised to a later date oradvanced, the admission validity period will be revised accordingly. Candidateswill be informed through email about the change in the batch start date. Anycandidate having an objection with the revised schedule may write to customercare@niit.com within 7 days or beforethe revised batch start whichever is earlier and discuss for alternate options,which may include cancellation of admission. NIIT will not be responsible forany financial damages / claims due to such changes.

Candidates would not be able to take a Break fromthe program or defer the admission to a later batch, once the batch hasstarted. For any unavoidable reasons, if the batch has to be changed as per thecandidate s requirement, the candidate may have to pay the applicableconvenience charges. In case of a batch change, the days and timings of the newbatch may be different from the current batch and NIIT does not assured thesame batch schedule.

FOREIGN NATIONALS

Admission to NIIT programs is open for learnersresiding in India only.

Foreign nationalsresiding in India seeking admission needs to upload /email a  copy of theValid Passport, Valid Student Visa for staying and studying in India, Validregistration with FRRO, and residential address proof to customercare@niit.com .

If placement service (Job Assurance / PlacementAssistance) is a part of the program offering, then for foreign nationals, theplacement service is subject to the recruiting organization s acceptance andthe candidate having a valid work visa. NIIT is not responsible to arrange awork visa or any other requirements related to the learner s placement, and theLearner will not be eligible for any refund of the program fee.

In case of any cancellation of the admission, therefund amount (if applicable) will be refunded to the same source accountthrough which the initial fee has been paid.

The onus of having all the valid documents,submitting the copies of the same to NIIT, and producing the originals ondemand, lies solely with the candidate. Noncompliance of the same shall lead tolegal consequences as per law.

LOAN FACILITY

NIIT, in the bestinterest of the Candidates, has enabled loan facility in association through 3^rd party Finance Companies(Lender). The Loan approval will be subject to the Learner's meeting theeligibility as determined by the Lender. Loan facility is applicable for selectprograms only.

Availing the loan through the Lender is optionaland is a personal choice of the candidate. Candidates can also register in theprogram by paying the full program fee without availing of the loan or canavail loan from any other sources.

Candidates availing the loan should familiarizethemselves with all the terms and conditions (such as the interest rates, EMIamount, moratorium period, foreclosure etc.,) applicable from the Lender beforeavailing of the loan.  The loan agreement is between the Candidate and theLender and NIIT has no role in the Loan process.

Candidates availing of the loan, need to pay theapplicable non-refundable booking fee to NIIT within the due date as mentionedin the Admission selection letter to reserve the seat in the selected batch.

Balance program fees, are to be paid after the loanis processed. Registration to the program is confirmed only on payment of thefull program fees.

If there is any delay in the loan process, and theregistration formalities are not completed before the last date of admissionfor the batch, then the Candidate will be accommodated in the next availablebatch at the time of registration. NIIT will not be responsible for any delayin either loan processing or loan disbursement.

If the Candidate s loan application is notapproved, then the Candidate can pay the balance program fee and register forthe program. If the candidate is not able to pay the requisite fee, then he/shecan apply for a refund of the booking fee. The Refund will be processed within10 working days and the amount will be credited to the Candidate s bankaccount. The refund of booking fee is only possible, if the loan is rejected bythe Lender and not if the Candidate wants to withdraw the admission offer.

Candidates availing of loan, need to pay applicableloan processing fee to the Lender at the time of loan approval. Candidatesshould pay their Loan EMIs directly to the Lender.

For Loan closure or cancellation of loan application,or any dispute related to the loan, the candidate is required to contact theLender directly and NIIT has no role in the same.

REGISTRATION CANCELLATION /REFUNDS

The Booking amount paid is non-refundable and willbe forfeited if the registration process is not completed within the due date.

The Learner can cancel the registration or withdrawfrom the Program any time.

If the cancellation request is submitted up to oneday before the batch start date, the Learner is entitled for full refund afterdeducting the non-refundable fee, payment gateway charges and applicable taxes.

If the cancellation request is submitted on orafter the batch start date (even if the candidate did not attend any sessionsand or did not avail any services), there will be no refund applicable.

If the cancellation of registration is due todelay/revision in starting the batch (program) from the scheduled start date orthe batch/program is canceled, then the Learner will be eligible for fullprogram fee refund.

If the Learner decides to discontinue the programafter the batch has started, there will be no refund of the program fee alreadypaid. If the Learner has availed any loan towards the program fee, the learnerwill carry the liability of repaying the full loan amount. If the Learner wantsto foreclose the loan or changes in the loan repayment terms, the Learnershould contact the Lender directly.

Subject to the Learner completing the programsuccessfully and meeting all the Placement requirements, If NIIT is not able toprovide a Job offer (Only applicable for Learners with Placement Assurance) forthe Learner within 90 days of the program completion as per the requirements,then NIIT will refund the program fee paid by the Learner after retaining thenon-refundable fee component (booking amount) and any other gateway chargeswith applicable taxes.

If the Learner is eligible for any refund and theLearner has availed the loan facility, then the refund amount will be paid tothe Learner after settling the outstanding loan amount with the Lender. Anyrefund to the Learner will be made to the Learner s bank account only.

There will be no refund applicable for Learnerswith Placement Assistance and Career Guidance Support only for not availing theplacement services.

There will be no refund on cancellation ofregistration due to disciplinary action initiated against the Learner.

PROGRAM PEDAGOGY

The program pedagogy follows an outcome driven,practitioner designed, immersive methodology.

The unique learning cycle Learn à Practice à Applyà Review à Refactor helps learners to learn from correcting their mistakes.

The Program ensures that the learner acquires therequired skills. NIIT believes by completing all activities as per the programdesign; every individual learner will acquire the necessary skills to be jobready.

All materials referred during the program aredigital contents and code. During the program duration, learners will haveaccess to the platform to access the digital contents. 

All Digital contents access provided by NIIT isstrictly for the use of Learner during the program only, and cannot be copiedor replicated or electronically transmitted or misused in any manner.

The medium of Instruction in the program will be inEnglish only.

PROGRAM SCHEDULE

Learner should abide by the program s academicmilestones and all other guidelines governing the execution and completion ofthe program. The Learner undertakes to put in his best effort towards improvingskills and knowledge by learning from the registered program.

The program is designed to be completed within theduration mentioned in hours. The Calendar time in weeks is for referencepurpose only. Actual duration is based on the Batch schedule such as Durationof the Sessions, No. of sessions in a Week, other planned / unplanned holidaysduring the period. Learners should refer to the Batch Schedule available inLearning Management System.

Since the program is outcome driven, the Learnerwill not be able to move ahead in the program until he/she completes theassignments. Therefore, the actual duration of the program would depend on theindividual Learner s participative interest, involvement and timely completionof the assignments/challenges.

If the Learner is not able to show progress as perthe batch schedule, then in the interest of the learner, NIIT may be compelledto transfer the Learner to another batch or schedule remedial sessions foreffective learning. Under such a situation, there might be a repetition of theprevious sessions and the planned end date of the program will be revised asper the new batch schedule. Any implications on EMIs towards the loan repaymentor moratorium period due to delay in completion of the program will be theLearner s responsibility only.

The Learner must honor the financial obligationeven if he/she decides to discontinue the program at any time.

Learners who would need to change the batch, fornot keeping pace with the current batch may have to pay the applicable batchtransfer convenience charges.

ASSESSMENTS

The Learner has to participate and complete all theassignments, assessments and project work successfully. This may include butnot limited to – quizzes, practice assignments, challenges, summativeassignments, time bound assignments, group discussions and peer reviews.

CERTIFICATION

The Learner will be awarded a Certificate, onsuccessful completion of all assignments, assessments and project work of theprogram.

The Learner has to be a Graduate to be awarded theProgram Completion Certificate.

Learners who do not clear the assessments /assignments and have not met the attendance requirements will not receive anycertificate.

A digitally verifiable certificate will be providedto the Learners, within 10 days of the completion of the program.

PLACEMENT

This program comes with Placement Services andapplicable to the Learners as per the criteria and other rules mentioned below:

 i.         The Learner sadmission must be within the Program defined Admission norms

ii.         The Learner musthave successfully completed the program  

iii.         The Learner musthave 100% Attendance in the Placement Engagement Sessions

All Graduates, not appearing or not clearing theAptitude Test and / or Age > 25 years but less than 28 years will beeligible for Placement Assistance only.

All Placement Services are provided to the eligibleLearners within 90days period after completion of the program successfully.

Placement with minimum CTC of 3 Lakhs per annum isapplicable for Learners with Placement Assurance service only.

For Learners with Placement Assistance, NIIT willprovide up to maximum THREE (3) selection opportunities only.

The Learner shall create, update, maintain andshare his/her profile/portfolio through the digital platforms (such asLinkedIn, GitHub, etc) to NIIT, as required for the Placement services.

The Learner is expected to co-operate with NIIT splacement process in entirety.

The Learner shall maintain high standards ofintegrity, attendance, punctuality, regularity and participate in the placementprocess.

NIIT shall provide adequate opportunities to theLearner to prepare and appear for the Interviews and other selection processes,to secure a placement.

The Learner shall regularly attend the placementpreparation modules, client briefing sessions and any other sessions asapplicable.

The Learner shall attend the placement selectionprocess (written test, Interviews, any other stages), anytime and anywhere inIndia as conducted by the Prospective employer at the Learner s own cost (if sorequired).

The placement provided will be anywhere in India.The Learner shall be ready to relocate at their own cost to any location as maybe offered by the Prospective employer.

The Learner shall be provided with Placementopportunities based on their technical skills, personality attributes, academicperformance etc. that will match with the Prospective Employer s requirements.Job opportunities in Organizations having high cut-off criteria in academicperformance will be offered to only those Learners who will meet the criteria.

Placement will be according to the terms ofemployment as laid down by the Prospective Employer and the Learner has toabide by the same.

The Learner shall be provided with the PlacementServices within 90 days of successful completion of the program.

NIIT shall be deemed to have discharged itsobligations regarding Placement Service towards a Learner under the followingcircumstances

 I.         ForPlacement Assurance:

        o     If the Learner has received atleast one offer letter with minimum CTC, from a Prospective Employer.

        o     If the Learner accepts aplacement offer from the Prospective Employer even if it is lower than theminimum CTC, considering various other advantages of the employment offer.

II.         ForPlacement Assistance:

        o     If the Learner has received atleast one offer letter as applicable for the program from a ProspectiveEmployer

        o     If the Learner has beenprovided with upto maximum three selection opportunities, irrespective of theLearner has availed the same or not.

III.         ForCareer Guidance Support: :

        o     NIIT will organize workshops /sessions on creation of online portfolio, LinkedIn profiling and soft skillsfor each batch. Learners are informed about the schedule of these eventsthrough email. It is the responsibility of the Learners to attend theseworkshops / sessions and benefit from the same. Once the schedule iscommunicated to the Learners and the sessions are conducted, the service isconsidered as delivered irrespective of the Learner attendance or not. Therewill be no repeat of any of these sessions.

IV.         Ifthe Learner voluntarily discontinues from the placement services

Non-participation or any other act ofnon-cooperation with NIIT or with the Partner Organization sSelection/Placement process, shall lead to the withdrawal of the Placementservices on disciplinary grounds, at NIIT s sole and absolute discretion.

For Learners with foreign nationality, theplacement service will be subject to the prospective employer accepting theprofile and sponsoring the necessary work visa. NIIT will not guarantee theplacement assurance or assistance for foreign nationals.

Learner with Placement Assurance service, will notbe entitled to any refund once NIIT has deemed to have discharged itsobligations regarding Placement Services towards the Learner under any of theabove mentioned circumstances, including Learner being expelled on disciplinarygrounds.

DIGITAL DEVICES

The Learner needsto have their own desktop or laptop Computer (refer to www.niit.com for requisiteconfiguration), Webcam, Headset with echo cancellation mic, broadband Internetconnectivity with minimum 20MBPS and Uninterrupted power supply to join thisprogram.

Registration to the Program implies that theLearner has the requisite infrastructure as per the details mentioned in theproduct webpage/ Program brochure. Not having the requisite hardware andconnectivity will affect the learning.

The Learner is responsible to arrange their ownresources (hardware/software/connectivity) as required to attend the Program.

The Learner is fully responsible for the proper functioningof the computer hardware and internet access.

NIIT is not responsible for the charges incurredfor the usage of hardware, software, or internet services provider fees.

For the procurement, installation, upgradation, ortroubleshooting of any hardware, the Learners need to contact their own vendorsand NIIT is not responsible for the same.

SOFTWARE

NIIT will only provide the details of the softwarerequired for the Program. It will be the responsibility of the Learners toarrange for the necessary open source or licensed software and install on theirdevices. Not having the requisite software will affect the learning.

For the procurement, installation, upgrade, ortroubleshooting of any software, the Learners need to contact their own vendorsand NIIT is not responsible for the same.

LEARNING MANAGEMENT SYSTEM(LMS)

As part of theprogram, NIIT will provide access to the online LMS through www.niit.com  portal.

The LMS will have the facility to attend online sessions,access to digital learning materials, session recordings, assignments, learningPlan as applicable for the program.

The access to the LMS will be for the period ofprogram completion only.

COMMUNICATION

To keep the Learner informed and updated about thelearning, and other services, NIIT may communicate with the Learner through anyone/or all possible medium such as SMS/Call (@registered mobile number), email(@registered email-ID) or by post (@residential address) or message on LMS.

All such communications sent to the Learner areconsidered as acknowledged and read.

It is theresponsibility of the Learner to update any change in their details, by writingto the helpdesk customercare@niit.com.

Learners should be aware that by taking admissionto any program at NIIT, they have given the consent to NIIT to use theirpersonal information which includes mobile number, email id and residentialaddress for communicating with them at present and in the future as well.

Learner confirms that laws in relation to theunsolicited communication referred in National Do Not Call Registry (the"NDNC Registry") as laid down by Telecom Regulatory Authority ofIndia will not be applicable for such communication/ calls/ SMS received fromNIIT, its employees, agents and/or associates.

For anygrievances, the Learner may write to customercare@niit.com.

DISCIPLINE

Learners are required to adhere to the norms ofdiscipline and decorum during the Online Sessions. Non-adherence to the samemay result in consequential penal action, which may even include cancellationof Admission.

Any Learner who is found using unfair means duringonline examinations, or while doing hands-on assignments and assessments, byindulging in activities like copying, discussions, using technology basedinstruments or other means to cheat, will be debarred from further continuationof the Program.

There will be Zero tolerance towards any form ofcopying. If there is even a small doubt about copying, the mentor may decidenot to evaluate the assignments submitted. Mentors decision is final in casesof plagiarism.

Indiscipline shall include, but not be limited tomisbehavior, nuisance, brawl, use of foul language in the online chat forums,posting objectionable material in the Learning Management System (LMS), use ofunfair means at the time of assessments, being drunk, having consumed narcoticssubstances, and indulging in any act or omission which amounts to discouraging/ demeaning/ hampering the program structure during the Online Sessions.

NIIT expects the Learner to resolve all mattersrelating to the enrolled program, delivery, fees, scholarship (if any) andplacement; directly with NIIT designated officer. Any attempt to bring anyoutside influence directly/or indirectly – upon any NIIT authority or NIITPartner Organization (if any) to further impact Learner s interests, in respectof matters pertaining to the association with NIIT and NIIT Services with any PartnerOrganization; would amount to a breach of admission contract and academicnorms. It would lead to debarring the Learner from availing further servicesfrom NIIT and thus will lead to initiation of appropriate action.

During the course of Learner s association withNIIT, the Learner will not take part in any demonstration/agitation againstNIIT and its officials for/or on behalf of any external bodies/politicaloutfits – either as a member or a sympathizer. Any act in contravention of theabove, would be treated as prejudicial to the interest and reputation of theinstitute leading to the initiation of appropriate action.

NIIT expects the Learner to notify NIIT officialsimmediately with the past and current details of any civil or criminal case(s)instituted against the Learner in any Court of Law or any complaint / showcause notice / prosecution with/by any Police Station or by any statutoryauthority, as also the Learner will notify any outcome of such complaint toNIIT in writing. Any act in breach of this term or suppression of facts wouldentail initiation of appropriate action as deemed fit by NIIT/PartnerOrganization.

PRIVACY POLICY

Learners are also supposed to abide by the privacypolicy, the terms and conditions mentioned in the LMS, and NIIT Student App atall times. Any unethical and unprofessional conduct by the Learner shall causecancellation of admission and forfeiture of the Program fee.

GENDER SENSITIZATION

NIIT does not discriminate or encourage any kind ofsexual harassment of women employees or Learners. Anyone found in violation ofthe same will be dealt with, as per the law.

MEDICAL FITNESS

Candidates enrolling in the program, confirms theunderstanding that this program is being offered through Online admission andthe training is delivered online, and they are medically fit to undergo thesame without any constraints.

Since the program is backed with placementassurance, the placement of the candidate post completing the programsuccessfully is subject to the candidate clearing the medical fitnessrequirements of the recruiting organization.

If the candidate is unable to clear / satisfy themedical requirements, NIIT will not be responsible for the placement of thecandidate and there will be no refund of the program fee. In such cases, NIITshall be deemed to have discharged its obligations towards the learner splacement.

AMENDMENTS

NIIT reserves the right to amend, modify, withdrawor substitute any of the terms and conditions without any prior notice.

The changes may be necessitated due to NIIT s focusin continuous improvement of the processes and services, research anddevelopment in the methodologies, pedagogy, technology obsolescence, industryrequirements and statutory compliances.  

All amendments will be updated in the Terms andConditions section of the LMS and will be notified to the Learners forinformation.

The Learners would be required to read and abide bythe amendments.

LEARNER S UNDERTAKING

Candidate understands that the application form isto be filled by themselves only and they are responsible for correctness andcompleteness of the information provided including the supporting documentsuploaded/submitted. Candidate also understand and agree that, if the detailsprovided are found to be incorrect / misrepresented any time, the admissionwill be cancelled and there will be no refund of the fees paid.   

A Candidatepaying the requisite program fee and registered for the program confirms thatthe Candidate / Learner has read, understood and agreed to allthe terms and conditions as mentioned in this document  www.niit.com website and has notrelied on any other oral representation by NIIT team or any 3^rd party.
